I'm glad that I've never seen a live copy of CIH though, that would really stink to find out that your BIOS has been wiped.

Oh yeah, it stinks alright! I had to replace my entire motherboard. This was back in like 1999. Can CIH still infect XP computers? But yeah, a reformat/reinstall won't get rid of CIH, because your computer will be dead and you won't be able to do either.

There's still plenty of viruses to mess with bios. Pest V4 Trojan allows users to remotly flash the bios of the infected computer i believe although ive never tested that.

Yep, same here, also at WalMart, you just never know. I figure that it would be much easier to make the case for a return, if you have the sales slip right there dated a few seconds ago, and have never left the store. They can't really argue that you swapping merchandise then. On the other hand, I've purchased some electronic/computer items from WalMart that were not sealed, and checking them before leaving the store, they looked to be in alright condition, some even looked new. I figure someone purchased them and couldn't get them to work or something, so their loss is my gain. Note that I don't ordinarily shop there for electronics, but sometimes you can cherry-pick the clearance items if you know what you're doing.

The BB is in Orange, CT

And no I don't charge 260 for reformat, reinstall THEY WHO SHALL GO UNNAMED (best buy for those unintuitive people) charge $260. They price matched me at $99. What a total ripoff, huh?

Well I would expect the store also transferred files and settings from the old installation at some point (it wasn't brought in for a reformat, so how would the customers know to get their data off?). If there really was a full reformat preventing an upgrade install then this would have been done by some automated utility afterwards. Now there are plenty of ways to pickup unwanted hitchhikers under this situation, like dangerious .exe and .doc files in the document folders getting copied over, maybe a favorite/bookmark that goes to one of the spyware installing sites, virus infected files, etc.

ya, you would think that they would transfer files and settings using a real utility, huh. Well guess what, this guy copied my documents onto the desktop and burned them onto a cd (the customer's cd no less). he also tried to copy the Microsoft Office program folder and burn it onto a CD to save the emails. Needless to say it didn't work!

This guy was an utter moron...lets think about this for a minute...the way he transfered files was he cut the directory c:/program files/microsoft office directory and burned it onto a cd. he then tried to drop it into place on the new install. THAT IS PATHETIC!!!!!

So there goes that justification for virus scanning

Another justification could be if there were multiple hard drives, some left unformated with dangerous files on them. In fact the store's polices could be written with this in mind even if it doesn't apply in this case. If none of the above applies and the store just returned a brand spanking new installation without anything from the old, then I guess I agree with you with (with the caveat of the already mentioned about boot sector virus).

nope. It was a brand spankin new installation. None of that is applicable.

I now have a case number from a very friendly BB rep named Mandy that has them giving me this bs line on the phone. Its recorded. I will personally be meeting with the family friend and going down to talk to Eddy (the geek squad director that said it) soon if this doesn't get resolved over the phone. It should be fun.

I wonder if he'll also try to convince me while I'm there to buy an Intel Celeron system because it's more reliable than my s939 fx-53 system coming and because it's faster because it runs @ 2.6ghz compared to 2.4ghz....
